Terms of use of DRIVIQ services
Introductory provisions
These General Terms of Use constitute a legally binding contract between you and the DRIVIQ platform and govern your access to and use of the services we provide. Please read these terms carefully before registering or using the services.
The DRIVIQ platform (“Provider”) provides services (“Service”) to you (“Customer”) through our websites and through our web and/or mobile applications. By using the Services, you accept the obligation to comply with these terms (“Terms of Use”). We reserve the right update and change the Terms of Use from time to time and we will notify you by the “Last Modified Date” below, at the end of the Terms of Use. It is your responsibility to familiarize yourself with the most recent version of the Terms of Use. Your continued use of the Services after any changes constitutes your acknowledgment and agreement to You can review the latest version of the Terms of Use at any time at https://www.driviq.eu/en/terms.All new features, including the publication of new tools and resources, will be subject to the then-current Terms of Use.
You represent and warrant that you have full right and authority to enter into and fully perform these Terms of Use in accordance with these Terms of Use. If you are using the Service on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that company or other legal entity to these Terms of Use and in such event “Customer” shall refer to and apply to such company or other legal entity.
User account
The use of the Service implies the fulfillment of certain prerequisites, whereby:
– The customer must be over 18 years old;
– The buyer must be human; accounts registered by robots (“bots”), artificial intelligence or other automated methods are not permitted;
– The customer must provide their full legal name, the legal name of your business (if applicable), a valid email address and any other information necessary to complete the registration process;
– The customer is responsible for the security of his password. We cannot and will not be liable for any loss or damage caused by the Customer’s failure to comply with this security obligation;
– The customer is solely responsible for any activity that occurs within the user account. In the event of any dispute between two or more parties regarding the ownership of a User Account, Customer agrees that Provider shall be the sole arbitrator of such dispute in its sole discretion and that Provider’s decision shall be final and binding;
– The customer can register one user account for one legal entity (company). Within the legal entity, the administrator account (fleet manager) and the employee (fleet user) account are distinguished;
– The customer must not abuse the Service or use the Service for any illegal purposes;
– Customer must not violate any laws, rules or regulations in its jurisdiction (including but not limited to copyright).
– Customer expressly agrees and acknowledges that it will not submit information that would violate your (or your employer’s) policies, including, without limitation, any data protection, privacy or security policies or any data protection laws, rules or regulations;
– Customer may not attempt to modify, translate, adapt, edit, copy, decompile, disassemble or reverse engineer any software used by us or provided by us in connection with the Service;
– The Service is constantly evolving and the form and nature of the Service may change from time to time;
– We reserve the right to change the Service from time to time, including adding or removing functions and features;
– The DRIVIQ system reserves the right to submit the user’s published content or his data to state agencies, competent authorities and judicial bodies in accordance with the obligations from Article 18 of Regulation (EU) 2022/2065 (Digital Services Act) and Article 14 paragraph 5 of Regulation (EU ) 2021/784 on the fight against the spread of terrorist content on the Internet, and for the purposes of conducting an investigation of the content published by the user. The user may be obliged to provide certain data at the request of state agencies, competent authorities and judicial authorities. We are obliged to notify the competent authorities and judicial authorities without delay and submit all relevant information as soon as we become aware of information that leads to the suspicion that a criminal offense has been committed or is likely to be committed or that a criminal offense is being committed that involves a threat to life or safety of a person or persons.
Authorized users
The Customer has the right to appoint individuals within the organization as authorized users of the Service (“Authorized User”). Employees and persons who are not employees or external collaborators can be Authorized Users. Customer shall take reasonable steps to ensure that all Authorized Users use the Service only as permitted by these Terms of Use and shall be responsible for compliance by all Authorized Users with all provisions of these Terms of Use, without limitation
